Terms of sale and subscription for Nausto

These terms apply when you buy Nausto Premium. Nausto is an app and web service for boat owners and crew: maintenance, equipment, logbook, parts, purchases and charts. The terms apply to sales to consumers. Rights you have under mandatory law apply even if they are not stated here, including under the Norwegian Digital Services Act, the Right of Withdrawal Act, the Contracts Act, the Marketing Control Act and the E-Commerce Act.

1. Who the agreement is between

Nausto is provided by BABO Norge AS, organisation number 978 669 794, Høielia 6, 2150 Årnes, Norway. In these terms the company is called “we” or “Nausto”. “You” are the private individual buying the subscription. To enter into the payment agreement you must be at least 18 years old and use a payment method you are entitled to use.

2. What Nausto and Premium include

Nausto is used in the browser at nausto.no and in the app on iPhone. Your account gives access to the same boats and data in both places. You need an internet connection to sign up, buy and synchronise; what you have recorded can be read and continued offline in the app.

Premium gives you all the tools: maintenance, tasks and checklists; parts inventory, shopping lists and new attachments; navigation with the chart, routes and offline chart packs on iPhone; and the AI assistant and interpretation of receipts and documents within the quota of 150 questions and 30 documents per calendar month. The chart is an aid and not an approved nautical chart; see the chart terms and sources.

The free logbook is yours without a subscription: trips, refuelling, notes and simple service history on your components. Everything you have recorded can be read and downloaded even after Premium ends, as long as the account and the boat exist.

Premium applies to your account and the boats you own in Nausto. If an owner has Premium, everyone on board gets the tools within their role, without a subscription of their own. A subscription you buy as crew does not give Premium to a boat you do not own.

What is included is shown on the front page and under Subscription in Nausto before you buy. Features that only appear in the roadmap are not part of the purchase until they have been delivered.

3. Free trial period

You get 30 days with all the tools the first time your account becomes the owner of a boat, whether you add it yourself or are made owner of an existing boat. The trial is given once per account; a new boat, a new owner role or a new sign-in does not give a new trial. In the trial, the AI assistant and document interpretation have their own quota: 30 questions and 5 documents for the whole trial period. It requires no payment details and does not turn into a paid subscription by itself. Without a purchase you continue with the free logbook when the trial ends.

If you buy while the trial is running, you keep the days you have left. You pay at the time of purchase, your access continues without interruption, and the purchased month or year starts where the trial ends. If the trial ends on 1 November and you buy a yearly subscription in October, Premium lasts until 1 November the following year. We show the trial end date, the purchased period and the next payment before you pay.

4. Price and payment

Premium costs NOK 799 per year or NOK 99 per month. Both give the same tools, and there are no additional fees.

The subscription is bought at nausto.no and paid with Vipps recurring payments. You approve the payment agreement and the first payment in Vipps. The subscription renews automatically at the chosen interval until it is cancelled or ended under these terms.

A month and a year are calendar periods: if the same date does not exist in the final month, the last day of that month is used. Dates and times follow Norwegian time.

5. Ordering and contract documentation

Before you pay, you see the subscription, the amount charged today, the trial end date if you have a trial, the purchased period, how long Premium lasts and the next payment, together with links to these terms and the privacy policy.

The agreement for a paid subscription is entered into when you approve the subscription and the payment in Vipps. The browser returning to Nausto is not on its own a confirmation that the payment has been completed.

We send the confirmation to the email address on your Nausto account, with the subscription, the price, the periods, the renewal, these terms and information about the right of withdrawal with a withdrawal form, so you can save them. You receive a receipt by email for every payment. If you do not receive the email, contact us; this does not limit your rights.

6. Delivery and access

Premium is available once the payment is confirmed, usually within a few seconds of your approval in Vipps. When you buy during the trial period, your access continues without interruption. If the payment is not completed, nothing is charged and no paid period is created.

Delivery is digital: nothing is shipped, and there is no postage. If Premium does not become available after the payment has gone through, contact support@nausto.no; your rights in the event of delay and defects are set out in section 12.

7. Renewal and notices

Monthly subscriptions renew one calendar month at a time, yearly subscriptions one calendar year at a time. The first renewal takes into account the trial days you kept. Renewals do not give a new trial.

Under Subscription in Nausto you see the plan, the price, the status, when the period ends and the next payment. The payment is taken the day before the period ends.

At least every six months we send you an email saying that the subscription is running, with how to stop it. Before a yearly payment we also send a reminder at least 14 days before the payment, with the amount and the date. This is contract information, not marketing, and does not require consent to news.

If a payment fails, Vipps retries for two days. If it still fails, the agreement is stopped, Premium lasts until the end of the period you have paid for, and you can buy again whenever you like. A paid period is never shortened because a later payment fails.

8. Stopping automatic renewal

You stop renewal with “Stop renewal” under Subscription in Nausto, by stopping the payment agreement in Vipps, or by telling us at support@nausto.no. You do not need to give a reason.

Once renewal is stopped, you keep Premium until the end of the period you have paid for, and the subscription does not renew afterwards. The trial days you kept are not lost. We confirm the stop and the end date by email. A stop given before the payment prevents a new payment period; if a payment is nevertheless taken, we correct it and refund it.

Month and year are not switched during a period: stop renewal and buy the other plan when the period is over. Deleting the app does not end the subscription; account deletion is described in section 13.

9. Ending before a paid period is over

A prepaid year does not bind you for twelve months. If you want to end your access before the period is over, send a message to support@nausto.no, for example from the subscription page. Your access ends on the date you choose, at the earliest the day we receive the message, and we confirm the date, the calculation and the refund.

You get back the part of the amount that covers the time after the end date, calculated proportionally over the purchased period, without any fee or deduction. Trial days you kept are not counted in the price. The same applies to monthly subscriptions. The refund is made without undue delay and no later than 14 days after the end takes effect, to the payment method you used.

10. Right of withdrawal and refunds

As a consumer you have a 14-day right of withdrawal from the day after the agreement for a paid subscription is entered into. You can withdraw without giving a reason: send a clear message to support@nausto.no, for example using the withdrawal form at the bottom. The deadline is met when the message is sent before it expires.

If you withdraw within the deadline, you get the full amount back, even if you have used Premium. We do not ask you to waive the right of withdrawal to get access, and we do not charge for use during the withdrawal period. Withdrawing also stops further renewal.

The refund is made without undue delay and no later than 14 days after we received the message, to the payment method you used, at no cost to you. Premium from the withdrawn purchase ends; a trial that is still running, Premium given by Nausto or another owner’s Premium is not affected, and you keep the free logbook and your history. Nothing has to be returned, and you do not need to delete your account to withdraw.

11. Changes to price, service and terms

We may change the price for future renewals when there is a valid reason, such as changed costs, taxes or content. The price for a period you have already paid for does not change. A price change is announced by email at least 30 days before it applies, with the old and new price and the date it applies from, so you can stop renewal before it takes effect.

We deliver the updates needed to keep the service as agreed. Other changes that affect the service negatively in a more than insignificant way are announced by email in reasonable time, with what changes, when, and the right to end the agreement free of charge under the Digital Services Act.

New terms are published on this page with a new date. A new text does not change an agreement you have already entered into, to your disadvantage, without notice and the grounds described here.

12. Delay, defects and complaints

Nausto shall be delivered and work as agreed and in accordance with the Digital Services Act. If the service does not work as agreed, contact support@nausto.no and describe what is wrong and which account it concerns. Never send passwords.

We fix defects free of charge and without significant inconvenience to you. Depending on the situation you may be entitled to withhold payment, demand rectification, a price reduction, termination and compensation under the law. We do not agree any shorter complaint deadlines than the law provides, and we do not disclaim statutory liability.

13. Account, content and personal data

You keep the rights to your own content. How we process your data, and what is shared with the crew, is described in the privacy policy.

You can export your data and delete your account yourself in Nausto. Stopping Premium is not the same as deleting the account. If you delete the account, we stop renewal, and unused prepayment is handled under sections 9 and 10 if you ask us to. Payment records we must keep under the Norwegian Bookkeeping Act are kept without any link to your account.

14. Termination by Nausto

In the event of a material breach we may end the agreement in accordance with the law; you will normally be notified and given the opportunity to remedy the matter. If we close down a paid service for other reasons, we give reasonable notice, let you retrieve your content and refund what you have paid for the time that is not delivered.

15. Complaints and dispute resolution

First contact support@nausto.no; we reply with our reasons. If we cannot agree, you can complain to the Norwegian Consumer Authority (Forbrukertilsynet), which mediates in consumer cases. Norwegian law applies, and any court case is handled under the ordinary rules of venue. You are not bound to arbitration.

16. Withdrawal form

Use this form if you want to withdraw from the agreement. The form is optional; any other clear message is equally valid. Send it to support@nausto.no or to BABO Norge AS, Høielia 6, 2150 Årnes, Norway.
